As a small, growing, social business, we're committed to these standards while acknowledging that some services may be delivered at basic levels initially and improved over time. We prioritize transparency about current capabilities and honest communication about any limitations.

By using our Services, you agree to these Terms of Use and our Privacy Policy. Please read them carefully.

1. ACCEPTANCE OF TERMS
Welcome to Fearless Project LLC ("Fearless," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of our website, services, courses, coaching programs, and any related content or materials (collectively, the "Services").

By accessing or using our Services, creating an account, or enrolling in any program, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Services.

2. ABOUT FEARLESS PROJECT
Fearless Project LLC is a Puerto Rico-based leadership development and organizational change studio (Business Registration No. 478459). We provide educational courses, coaching services, consulting, speaking engagements, and community resources designed for social impact professionals working to create positive change in the world.

Our flagship offerings include:

  • Coaching programs (available in English, French, Spanish, Urdu/Hindi)
  • Consulting services
  • Speaking engagements
  • Membership communities
  • Free educational resources

3. ELIGIBILITY AND ACCOUNT REGISTRATION
Age Requirements
  • You must be at least 18 years old to create an account or enroll in our programs
  • If you are under 18, you may only use our Services with the explicit consent of a parent or legal guardian
  • For users in jurisdictions where the age of majority is higher than 18, you must meet that jurisdiction's age requirement

Account Creation
  • You are responsible for providing accurate, complete, and current information during registration
  • You must maintain and promptly update your account information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You agree to notify us immediately of any unauthorized use of your account
  • You may only create one account per person

4. PROGRAMS AND SERVICES
Course Enrollment
  • Course enrollment requires full payment prior to program commencement unless alternative payment arrangements have been specifically agreed upon
  • Programs are designed as complete packages and are not meant to be altered or partially completed
  • Attendance at live sessions may be required to maintain eligibility for certain program benefits, including refund guarantees
  • Live sessions are recorded with participant consent for educational, reference, and marketing purposes

Coaching Services
  • Coaching relationships are governed by separate coaching agreements that supplement these Terms
  • All coaching sessions are scheduled in advance on a recurring basis
  • Cancellations must be made at least 24 hours in advance
  • Sessions not rescheduled within 7 days of the original date may be deemed forfeited
  • Coaching services are available in multiple languages (English, French, Spanish, Urdu/Hindi) upon request
  • Individual coaching sessions are recorded with your consent for note-taking and reference purposes

Community Access
  • Certain programs include access to private communities (such as WhatsApp groups)
  • Community participation is subject to our Community Guidelines (Section 9)
  • Community access may be revoked for violations of these Terms or Community Guidelines

Professional Boundaries and Crisis Management
  • Our coaching services are professional development coaching, not therapy or medical treatment
  • We do not provide legal, financial, or medical advice
  • If you experience a mental health crisis or express thoughts of self-harm during our services, we will pause our session and refer you to appropriate crisis resources and mental health professionals
  • We maintain a referral list of qualified therapists and counselors but do not formally manage referral relationships
  • During coaching, we will clearly indicate when switching from coaching mode (asking questions) to consulting mode (providing advice)

5. PAYMENT AND REFUND POLICY
Currency and Payment Methods
  • All prices are listed in United States Dollars (USD)
  • We accept payments in other currencies upon request
  • Payment processing fees and currency conversion costs are determined by our payment processors (Stripe, Wise)
  • Alternative payment methods (bank transfers, PayPal, etc.) may be available upon request for international clients

Payment Terms
  • All fees are due in full prior to program commencement unless payment plan arrangements have been made
  • Payment plans, when available, must be adhered to according to the agreed schedule
  • Late payments may result in service suspension and additional fees
  • Payment default may result in program cancellation

Refund Policy
SPA Course:
  • Full participation in the 90-day program is required for refund eligibility
  • You must apply the POWER Method to real partnership challenges
  • Within 30 days of program completion, if you haven't improved your ability to navigate partnership conversations, influence stakeholders, or build trust with local partners, you may request a full refund
  • Refunds will be processed within 7 business days of approval

Coaching Services:
  • If you feel we're not the right fit after the first session, we'll provide a full refund minus administrative and processing fees (15% of total cost)
  • After the second session, we'll provide a 50% refund if you decide to discontinue
  • No refunds are available after the third session

General Refund Conditions:
  • Refund requests must be submitted in writing to hello@fearlessproject.co
  • No refunds, credits, or transfers are available for no-shows
  • Payment processing fees are non-refundable
  • Refunds will be processed in the original currency when possible, subject to currency conversion rates at time of processing

6. INTELLECTUAL PROPERTY RIGHTS
Our Content
  • All content, materials, frameworks, methodologies (including the POWER Method), designs, graphics, text, software, and other intellectual property available through our Services are owned by Fearless Project LLC or our licensors
  • Our content is protected by copyright, trademark, and other intellectual property laws
  • You may not use our trademarks, logos, or proprietary frameworks without our express written permission

Your License to Use Our Content
  • We grant you a limited, non-exclusive, non-transferable license to access and use our content solely for your personal, non-commercial use as a participant in our programs
  • You may not reproduce, distribute, modify, create derivative works, publicly display, or commercially exploit our content without written permission
  • Course recordings, materials, and resources are for your personal use only and may not be shared with others

Attribution Requirements
  • If you reference our proprietary frameworks (such as the POWER Method) in any public or professional context, you must provide appropriate attribution to Fearless Project LLC
  • Third-party research and expert content used in our materials maintains its original attribution requirements

User-Generated Content and Session Recordings
  • You retain ownership of any content you submit or create during our programs
  • By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute your content for program improvement and promotional purposes
  • You represent that you have all necessary rights to grant this license
  • By participating in recorded sessions, you consent to being recorded and agree that we may use these recordings for program delivery, improvement, and your reference
  • Group session participants consent to being recorded together and understand that other participants will be visible/audible in recordings

7. PROHIBITED USES
You agree not to use our Services to:

Account and Access Violations
  • Share your login credentials with others
  • Create multiple accounts
  • Access accounts belonging to others
  • Circumvent any security measures or access restrictions

Content and Intellectual Property Violations
  • Record, copy, or redistribute course content, materials, or recordings without permission
  • Use our content for commercial purposes without authorization
  • Remove or alter copyright notices or attribution
  • Violate any third-party intellectual property rights

Harmful or Disruptive Behavior
  • Harass, intimidate, or abuse other users or staff members
  • Post or transmit harmful, offensive, or inappropriate content
  • Engage in spam, self-promotion, or commercial solicitation in community spaces
  • Attempt to hack, disrupt, or compromise our systems or other users' access

Legal and Ethical Violations
  • Violate any applicable laws or regulations
  • Engage in fraudulent activities
  • Impersonate others or misrepresent your identity
  • Use our Services in any way that could damage our reputation or business

8. THIRD-PARTY SERVICES AND TECHNICAL REQUIREMENTS
Technical Requirements
  • High-speed internet connection is strongly recommended for optimal participation
  • Compatible device (computer, tablet, or smartphone) with current web browser
  • Audio/video capabilities for coaching sessions and live course components
  • Current versions of software applications as required for specific programs

Technical Support
  • We provide basic technical support for our platforms and can refer you to third-party technical support as needed
  • You are responsible for maintaining your internet connection and device functionality
  • In case of technical failures during scheduled sessions, we will attempt alternative delivery methods and/or reschedule

Third-Party Service Integration
Our Services integrate with various third-party platforms and tools, including but not limited to:
  • Fireflies.ai (session recording and note-taking)
  • Zoom (video conferencing)
  • YouTube (content hosting)
  • Google Workspace (file sharing and communication)
  • Calendly (scheduling)
  • LinkedIn (professional networking)
  • Circle.so (community management)
  • Maven (learning platform)
  • Stripe and Wise (payment processing)

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or policies of these third-party providers.

9. COMMUNITY GUIDELINES
Participation in our communities (including WhatsApp groups, online forums, and live sessions) requires adherence to these guidelines:

Respectful Interaction
  • Respect diverse perspectives, backgrounds, and experiences from our global community
  • Maintain professional communication standards across cultural contexts
  • Support fellow community members' growth and development
  • Engage constructively in discussions and activities
  • Be mindful of different time zones and cultural holidays when scheduling or expecting responses

Appropriate Sharing
  • Share insights and experiences that contribute to collective learning
  • Respect the confidentiality of personal information shared by others
  • Avoid sharing sensitive business information without proper authorization
  • Keep discussions relevant to program topics and objectives

Prohibited Community Behavior
  • No harassment, discrimination, or abusive behavior
  • No commercial promotion or spam
  • No sharing of inappropriate, offensive, or harmful content
  • No violation of others' privacy or confidentiality
  • Violation of these guidelines may result in removal from community spaces and, in severe cases, termination from programs without refund.

10. DATA PRIVACY AND RETENTION
Personal Information
  • Our collection and use of personal information is governed by our Privacy Policy
  • We retain personal data as long as you have an account with us
  • You may request deletion of your personal data by contacting hello@fearlessproject.co
  • Some information may be retained for legal or business purposes even after account deletion

Program Content and Progress
  • We retain course materials, progress records, and program-related data indefinitely for program improvement and research purposes
  • Session recordings and notes generated through AI tools like Fireflies.ai are kept confidential and used solely for program delivery and your reference

11. DISCLAIMERS AND LIMITATIONS
Educational Nature
  • Our Services provide educational content and coaching support for professional development
  • We do not guarantee specific outcomes, job placements, salary increases, or career advancement
  • Individual results may vary based on personal effort, market conditions, and other factors beyond our control

Professional Boundaries
  • Our coaching services are not therapy or medical treatment
  • We are not licensed therapists, counselors, or mental health professionals
  • If professional therapy or specialized advice is needed, we will provide appropriate referrals
  • Our coaching focuses on professional development and career growth, not personal therapy or crisis intervention

Technology and Service Availability
  • We strive to maintain reliable service but do not guarantee uninterrupted access
  • Technical issues, maintenance, or force majeure events may temporarily affect service availability
  • We are not liable for losses resulting from service interruptions
  • Internet connectivity issues on either party's end may require session rescheduling

Global Service Considerations
  • Services are provided from Puerto Rico and may be affected by local holidays and events
  • We accommodate major holidays from participants' countries when scheduling
  • Time zone differences may affect real-time support availability
  • Cultural and regional differences in business practices are acknowledged but do not alter these Terms

12. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Fearless Project LLC, its officers, directors, employees, contractors, and agents from and against any claims, damages, costs, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:
  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content you submit or share through our Services

13. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
  • OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM
  • WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • WE SHALL NOT BE LIABLE FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR OTHER INTANGIBLE LOSSES

Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you.

14. DISPUTE RESOLUTION
Governing Law
These Terms are governed by the laws of the Commonwealth of Puerto Rico and the United States, without regard to conflict of law principles.

Dispute Resolution Process
  • Informal Resolution: Before pursuing formal dispute resolution, we encourage you to contact us at hello@fearlessproject.co to discuss any concerns
  • Mediation: If informal resolution is unsuccessful, disputes will first be addressed through mediation administered by a mutually agreed-upon mediation service
  • Binding Arbitration: If mediation fails to resolve the dispute, it will be settled through binding arbitration

Arbitration Terms
  • Arbitration will be conducted according to the rules of the American Arbitration Association
  • Arbitration may be conducted in Puerto Rico or through virtual proceedings to accommodate international participants
  • Each party will bear their own costs and fees
  • The arbitrator's decision will be final and binding
  • You waive any right to participate in class action lawsuits or class-wide arbitration

15. PROGRAM MODIFICATIONS AND CANCELLATIONS
Our Right to Modify
  • We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time
  • We will provide reasonable notice of material changes to programs you've enrolled in
  • If we make substantial changes that negatively affect your program experience, we may offer appropriate remedies including pro-rated refunds

Force Majeure
  • We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, acts of government, pandemics, internet outages, political instability, or other force majeure events
  • In such cases, we may suspend services temporarily, offer alternative delivery methods, or provide rescheduling options
  • Force majeure events affecting either party's location (Puerto Rico or your jurisdiction) may impact service delivery

16. TERMINATION
Termination by You
  • You may terminate your account and stop using our Services at any time
  • Refund eligibility for paid programs is subject to the refund policies outlined in Section 5
  • Upon termination, your right to access our Services will cease immediately

Termination by Us
  • We may terminate or suspend your access to our Services at any time for violation of these Terms
  • We may terminate accounts for non-payment, inappropriate behavior, or other business reasons
  • Upon termination for cause, no refunds will be provided

Effects of Termination
  • Upon termination, you must cease all use of our Services and delete any downloaded materials
  • Sections of these Terms that by their nature should survive termination will remain in effect

17. GENERAL PROVISIONS
Entire Agreement
These Terms, together with our Privacy Policy and any specific program agreements, constitute the entire agreement between you and Fearless Project LLC regarding the use of our Services.

Amendments
We may update these Terms from time to time. Material changes will be communicated through email notification or prominent notice on our website. Your continued use of our Services after such changes constitutes acceptance of the updated Terms.

Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

Assignment
You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign our rights and obligations under these Terms without restriction.

Language
These Terms are primarily written in English. While we may provide services in multiple languages, the English version of these Terms shall control in case of any conflict with translations.

  • Community interactions may be visible to other program participants
  • We may use anonymized examples from sessions for educational purposes

Testimonials and Case Studies
  • We may request permission to use your feedback and success stories for promotional purposes
  • You can withdraw consent for using your testimonials at any time
  • Case studies are created with anonymized or aggregated information when possible
